Spontaneer LLC  — Terms & Conditions

1. Parties, Scope & Acceptance

1.1 Parties. These Terms are between Spontaneer LLC (“we/us/our”), a Washington-based travel concierge company, and you, the client (“you/your”).
1.2 Scope / Services. We provide personalized travel concierge services, including itinerary design, booking coordination, vendor sourcing, and travel support (“Services”).
1.3 Acceptance. By engaging our services, signing any agreement, or submitting payment, you accept these Terms.
1.4 Supplier Terms. You acknowledge that travel suppliers (airlines, hotels, tour operators, etc.) impose their own terms and policies. These govern your bookings alongside ours.

2. Client Responsibilities

2.1 Authority. You confirm you are at least 18 years old and authorized to make decisions for all travelers in your party.
2.2 Accuracy. You must provide accurate traveler information. We are not liable for issues arising from errors or omissions.
2.3 Approvals. You are responsible for reviewing and approving all proposals or itineraries before we confirm bookings.

3. Fees, Payments & Billing

3.1 Fees. Concierge service fees apply as per your selected plan or agreement. These fees are separate from the cost of travel arrangements.
3.2 Non-Refundability. All or part of the service fee may be non-refundable once work has begun.
3.3 Supplier Payments. Payments for flights, hotels, and tours may be made directly to suppliers or through Spontaneer on your behalf.
3.4 Chargebacks. Unjustified chargebacks may result in recovery of related costs and termination of services.
3.5 Taxes & Currency. Prices may fluctuate due to exchange rates, taxes, or surcharges until full payment is made.

4. Changes, Cancellations & Refunds

4.1 Changes. Any post-confirmation change requests may incur supplier or service fees.
4.2 Cancellations. Written notice is required for cancellations. Supplier penalties may apply.
4.3 Refunds. Refunds follow the policies of the respective suppliers and are not guaranteed by Spontaneer.

 

5. Travel Documents & Risk

5.1 Documents. You are responsible for valid passports, visas, vaccinations, and travel compliance.
5.2 Timeliness. You must arrive on time for flights, transfers, and tours.
5.3 Force Majeure. We are not liable for circumstances beyond our control (e.g. weather, strikes, or political unrest).

6. Liability, Disclaimers & Indemnification

6.1 Agent Role. Spontaneer acts as an intermediary for disclosed suppliers.
6.2 Limitation of Liability. Our total liability is limited to the amount of service fees paid to Spontaneer.
6.3 Indemnification. You agree to indemnify Spontaneer and its affiliates against claims arising from your breach or negligence.
6.4 No Warranty. We make no warranty regarding travel outcomes or satisfaction beyond reasonable professional diligence.

7. Insurance

We strongly recommend obtaining comprehensive travel insurance for cancellations, medical emergencies, and supplier defaults. Spontaneer is not an insurance provider.

8. Dispute Resolution & Governing Law

This Agreement is governed by the laws of the State of Washington, USA. Any disputes shall be resolved in King County courts. Claims must be filed within 30 days of the issue or conclusion of travel.

9. Modifications

Spontaneer reserves the right to amend these Terms at any time. The version effective on the date of service engagement applies.

10. Miscellaneous

If any provision is deemed invalid, the remaining terms remain enforceable. This document represents the entire agreement between you and Spontaneer.
